Welcome to Points Club Rewards by H-E-B™ and Points Club Rewards by H-E-B plus!™. Thank you for joining this Program that rewards you for shopping at H-E-B. Points are offered under the Program at the sole discretion of H-E-B. These Terms and Conditions (as revised from time to time by H-E-B) constitute the entire agreement between you and H-E-B with respect to your participation in the Program. These Terms and Conditions describe the way you accumulate Points and receive benefits. To get the most out of the Program, please read this document and make sure that you understand it.
By enrolling in the Program or by accumulating Points, you agree that you have read and understand these Terms and Conditions and that you agree to be bound by these Terms and Conditions. These Terms and Conditions become effective February 27, 2015, and replace the Terms and Conditions applicable to the Program prior to that date.

We value your membership, so please take a minute to read the following details about the Program.
To become a Member, you must be at least 16 years of age and have a valid address in Texas.
You may accumulate Points and redeem H-E-B Reward Dollars at all Waco H-E-B stores.
We will issue three (3) Points Club Rewards® cards and three (3) key tags to each household when a Member of the household enrolls in the program. We ask that you distribute these cards among your household members. We will award the Points allocated to the three (3) cards and three (3) key tags to the household's account. If you need additional cards for your household please contact us by phone at 1-877-432-7687.
There is currently no charge for the first set of three (3) cards and three (3) key tags issued to the same account. Due to operating costs, we may, at our sole discretion, charge a fee for additional or replacement cards and key tags. Please contact us immediately at 1-877-432-7687 if any card or key tag is lost or stolen.
Points issued or recorded on your account under the Program remain the property of H-E-B. Points do not have cash value and cannot be redeemed for cash or currency. Points cannot be traded, mortgaged, bartered, licensed or disposed of and you may be legally prevented from doing so. Points are not transferable, including at time of death, as part of a divorce or other domestic relationship matter or otherwise by operation of law. We may cancel any Points that you attempt to transfer in violation of these Terms and Conditions. As described more fully below, H-E-B will issue H-E-B Reward Dollars to you quarterly based on your total Points accumulation.
Membership in the Program and its benefits are offered at the sole discretion of H-E-B.
To accumulate Points on any transactions in participating stores, swipe your Points Club Rewards card or key tag or input your mobile phone number plus 4-digit PIN number on the payment terminal (subject to store acceptance policies and limitations) upon checkout. To make use of this mobile phone feature, you must register your mobile phone number and Points Club Rewards Membership number on www.heb.com/pointsclub. Please call Member Services toll free, 1-877-432-7687, Monday through Friday from 8 am to 6 pm, if you need assistance. To accumulate Points on any transactions at our fuel kiosks, you can either: (a) pay for your purchase at the gas station kiosk and swipe your Points Club Rewards card or key tag or input your mobile phone number plus 4-digit PIN number on the payment terminal; or (b) if you pay at the fuel pump, insert your full-sized Points Club Rewards card when prompted.
If you do not have your Points Club Rewards card or key tag at the time of purchase, please call Points Club Rewards by H-E-B at 1-877-432-7687 or log on to www.heb.com/pointsclub and have your account number and transaction number, located on the receipt, available. A request to issue and record Points for a purchase made without your Points Club Rewards card or key tag must be made within ninety (90) days from the date listed on the receipt. Requests for the issuance or recording of Points made after ninety (90) days from the date listed on the receipt will not be honored. Points accrual can be tracked through account statements, online (www.heb.com/pointsclub), by phone (1-877-432-7687) or as noted on your receipt.
Earning Your Points Club Rewards
You will be issued fifteen (15) Points for per dollar($1) you spend ($0.20 minimum) on identified items within the store using your Points Club Rewards card, key tag or mobile phone number plus 4-digit PIN. You will also be issued five (5) Points per dollar ($1) you spend ($0.20 minimum) on all other items using your Points Club Rewards card or key tag or mobile phone number plus 4-digit PIN.
In addition, you will be issued one hundred (100) Points for each business center transaction using your Points Club Rewards card, key tag or mobile phone number plus 4-digit PIN ($0.25 minimum purchase required) and 25 Points per transaction plus five (5) Points per dollar for the amount you pay for your pharmacy purchases (excluding portion paid by insurance carrier and government funded prescriptions) using your Points Club Rewards card, key tag or mobile phone number plus 4-digit PIN. Bonus Point amounts/levels may vary, are assigned and may be changed or modified solely at the discretion of H-E-B.
Points will not be issued for the purchase of lottery sales, portions of a pharmacy prescription paid by insurance or sales tax amounts, purchases made via third-party shopping or delivery services, or purchases made on behalf of another individual or entity (that is not a member of your household)
H-E-B determines the conditions under which it will permit you to earn Points and may change those conditions at any time, with or without notice.
You are responsible for and must pay all third-party liabilities, if any, including, but not limited to, taxes, fees and other charges imposed with respect to your accumulation of Points or rewards under the Program.
We will only record Points to your account that are issued as a result of purchases made by you or by someone whose membership card is registered to your household. Additionally, purchases must be for the purchaser's personal or household use only. Purchases made for later reimbursement by or on behalf of a third party (including by personal shoppers or delivery service providers) will not be eligible for Points. Purchases must be made at any of the Waco H-E-B stores. We are not responsible for any delay or error in recording Points to your account.
We may refuse to record or honor Points to your account, or, if already recorded, may cancel such Points, if we cannot confirm that such Points were properly issued or recorded. Without limiting the foregoing, we may cancel issued or recorded Points if we believe that such Points were issued or recorded as a result of fraud or theft.
We may terminate your enrollment in the Program and cancel all Points issued or recorded to your account if: (a) no Points are issued or recorded to your account, or redeemed from your account, for a period of twenty-four (24) months or more; (b) if you become bankrupt; or (c) if you do not comply with any of these Terms and Conditions or if you otherwise abuse your Program privileges or act to the Program's detriment (determined at the sole discretion of H-E-B). Termination of your enrollment in the Program or cancellation of your issued or recorded Points will not limit or otherwise affect any other rights available to H-E-B. If a Point expires, is cancelled or is forfeited for any reason, such Point may not be redeemed under the Program.
If at any time within thirty (30) days following the date H-E-B Reward Dollars are issued you believe that the number of Reward Dollars credited to your card is incorrect, please contact us, toll free at 1-877-432-7687. After thirty (30) days following the date Reward Dollars are issued, all credited Reward Dollars will be deemed correct and will not be subject to change or modification provided, however, that H-E-B reserves the right to change or modify Points recorded and Reward Dollars credited to your account in a manner not permitted under these Terms and Conditions.
Getting Your Points Club Rewards H-E-B Reward Dollars
Quarterly, H-E-B will issue H-E-B Reward Dollars for Points recorded under the Program. At such time, we will convert recorded Points into H-E-B Reward Dollars if your Points total meets the minimum balance criteria of 1,000 Points. You will receive one (1) H-E-B Reward Dollar for every 1,000 Points recorded and 1 penny for every 10 points accumulated. Recorded Points in an amount less than 1,000 Points will be forfeited at the end of each quarter. For example, 3,830 Points recorded in the first quarter will result in three (3) H-E-B Reward Dollars and 83 H-E-B cents. Reward Dollars will be credited to your card and may be redeemed by presenting your card at any Waco H-E-B Cash Register. H-E-B Reward Dollars are valid for ninety (90) days from date of issue.
H-E-B Reward Dollars may only be redeemed for products or services (other than Business Center transactions, alcohol or lottery tickets at Waco H-E-B stores). H-E-B Reward Dollars do not have cash value and cannot be redeemed for cash or currency. We are not responsible for lost or stolen H-E-B Reward Dollars.

THE PROGRAM IS PROVIDED ON THE EXPRESS CONDITION THAT NEITHER H-E-B NOR ANY H-E-B OFFICER, EMPLOYEE OR DIRECTOR HAS ANY RESPONSIBILITY OR LIABILITY OF ANY NATURE FOR ANY EXPENSE, LOSS, INJURY OR OTHER CLAIM OR DAMAGE DIRECTLY OR INDIRECTLY ARISING OUT OF OR RELATED TO THE PROGRAM.
THE PROGRAM IS PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS AND H-E-B EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
3. Limitation of Liability
A COVERED PARTY (DEFINED BELOW) SHALL NOT BE LIABLE FOR ANY EXPENSE, LOSS, INJURY OR OTHER CLAIM OR DAMAGE INCURRED, INCLUDING WITHOUT LIMITATION COMPENSATORY, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, CONSEQUENTIAL OR EXEMPLARY DAMAGES OR DAMAGES FOR LOSS OF INCOME OR PROFITS HOWEVER CAUSED AND WHETHER ARISING BY STATUTE, COMMON LAW OR OTHERWISE (INCLUDING UNDER CONTRACT OR BY TORT LAW), IN CONNECTION WITH: (i) THE PROGRAM; (ii) ANY FAILURE, DELAY OR DECISION BY H-E-B IN ADMINISTERING THE PROGRAM OR AMENDING THESE TERMS AND CONDITIONS; (iii) THE USE OF OR INABILITY TO USE THE H-E-B SITE OR SERVICE CENTER; OR (iv) THE PURCHASE, REDEMPTION FOR OR USE OF ANY GOODS OR SERVICES OF SPONSORS OR REWARDS SUPPLIERS, EVEN IF A COVERED PARTY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, CLAIMS OR LOSSES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY, ANY FUNDAMENTAL BREACH OR ANY BREACH OF A FUNDAMENTAL TERM. "COVERED PARTY " MEANS H-EB GROCERY COMPANY, LP, ITS AFFILIATES, AND ANY OFFICER, DIRECTOR, EMPLOYEE, SUBCONTRACTOR, AGENT, SUCCESSOR OR ASSIGN OF ANY OF THEM. IN ANY EVENT, ANY LIABILITY WE MAY HAVE TO YOU FOR ANY NEGLIGENCE, BREACH OF CONTRACT OR OTHERWISE UNDER ANY CIRCUMSTANCES, IS LIMITED TO RECORDING TO YOUR ACCOUNT THE NUMBER OF POINTS YOU REDEEMED IN CONNECTION WITH SUCH CIRCUMSTANCES.
4. Governing Laws in Case of Dispute; Jurisdiction
These Terms and Conditions shall be governed by the laws of the State of Texas, as they apply to agreements made and solely performed therein, without regard to conflicts of laws and provisions. Disputes arising hereunder or in any way related to the Program shall be exclusively subject to the jurisdiction of the Federal Courts of the United States of America and/or the State Courts of Texas located in Bexar County.
5. Changes to the Program, Site and these Terms and Conditions
H-E-B may change these Terms and Conditions with or without notice. Please review this link on a regular basis for changes to these Terms and Conditions. Continued use of this Site following any change(s) to these Terms and Conditions constitutes your acceptance of such change(s).
H-E-B has the right to change, limit, modify or cancel the Program, Program rules or regulations, the Program Terms and Conditions, the rewards and Points structure and levels, or impose fees or charges at any time, with or without notice, even though such changes may affect the value of Points already accumulated, the ability to use accumulated Points or the ability to obtain certain rewards or Points.
6. Data Collection
H-E-B collects, stores and uses data gathered through purchases made under or in connection with the Program. This information includes but is not limited to personal information that identifies you (such as name or address), e-mail address and sales transaction data. This data may be shared with and used by third parties in order to help us and our business partners better understand and serve our customers, to customize your shopping experience, to present you with promotions or other marketing communications we believe may be of interest to you, or to measure and improve the quality and effectiveness of our store service, the Program and other program offerings. We may also use this data in the conduct of our internal loss prevention efforts to avoid unnecessary loss to H-E-B. By using the Program you consent to H-E-Bâ€™s use of information about you as set forth in these Terms and Conditions. If you do not agree with these Terms and Conditions, you may choose not to use the Program.
All materials and any notices will be sent to you at the mailing address, issued coupon at the register or e-mail address contained in our records. If you change your mailing address or e-mail address, please inform us by e-mailing us or calling us at 1-877-432-7687.
H-E-B has the sole discretion to interpret and apply these Terms and Conditions and adjudicate other questions or disputes relating to the Program.
The redemption of Points by H-E-B under circumstances not required by these Terms and Conditions shall not be deemed a waiver of these Terms and Conditions and shall not affect or impair any other rights available to H-E-B.
If any part, term or provision of these Terms and Conditions is declared or determined by a court of proper jurisdiction to be illegal, invalid or unenforceable, in whole or in part, the validity of the remaining parts, terms or provisions shall not be affected and shall remain in full force and effect.
These Terms and Conditions (as revised from time to time by H-E-B) constitute the entire agreement between you and H-E-B regarding your participation in the Program, your accumulation and redemption of Points and any other benefits of the Program. To the maximum extent permitted by law, we exclude all conditions, representations, warranties and other terms which might otherwise be implied into or incorporated into these Terms and Conditions, whether by statute, common law or otherwise, including, but not limited to, implied warranties and terms as to merchantability, satisfactory quality, fitness for any particular purpose, and non-infringement with respect to any rewards, and implied warranties and terms arising from course of dealing or course of performance. H-E-B is not responsible for any statement or claim any third party may make about the Program.

BY PARTICIPATING IN THE PROGRAM, YOU EXPRESSLY AGREE TO THESE TERMS AND CONDITIONS. IF YOU ENROLLED IN THE PROGRAM ELECTRONICALLY VIA THE SITE AND/OR ARE VIEWING THESE TERMS AND CONDITIONS ONLINE VIA OUR SITE AND/OR CHOOSE TO COMMUNICATE WITH US USING E-MAIL OR OTHERWISE CONDUCT TRANSACTIONS WITH US ELECTRONICALLY, THEN YOU EXPRESSLY CONSENT TO RECEIVING OR ACCESSING RECORDS RELATING TO THE PROGRAM AND/OR YOUR ACCOUNT AND/OR OTHERWISE ADMINISTERING YOUR ACCOUNT ELECTRONICALLY, AS DETERMINED BY US.
