Pepsi / Ryland Home, Sweet, Home Giveaway Official Sweepstakes Rules NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. 1. HERE'S HOW TO ENTER: Hand-print your name, street address, city, state, zip code and daytime and evening phone numbers on an official entry form found at participating H-E-B stores and Ryland Home Community Sale Office locations in the Austin, Houston, Rio Grande Valley and San Antonio regions or on a plain piece of 3"-x-5" paper. Mail your completed entry to: "Pepsi/Ryland Home, Sweet, Home" Sweepstakes, P.O. Box 7780, Melville, NY 11775-7780. Limit one entry per person per day. Each entry must be mailed separately in a hand-addressed, stamped envelope. No photocopied or mechanically reproduced entries will be accepted. No responsibility is assumed for lost, late, illegible, incomplete, misdirected, or postage-due mail or entries. All entries become the property of sponsors and will not be returned. Contest period begins April 28, 2004 and ends June 1, 2004. All entries must be postmarked by June 1, 2004 and received by June 5, 2004. 2. PRIZES: Five (5) Finalist prizes will be awarded. Each prize will consist of 3-day/2-night hotel accommodations for four in San Antonio, TX from 6/25/04-6/27/04 (quadruple occupancy), ground transportation to/from Grand Prize Giveaway location/hotel (Giveaway Event Location: Outside of Main Gate at SeaWorld San Antonio), (4) 1-day tickets to SeaWorld San Antonio, $500 H-E-B Gift Card and a $200 travel stipend. Transportation to/from finalist's home/hotel not included. No alternate date is available and prize will be forfeited if potential winner is unable to travel on designated date. Approximate Retail Value of Finalist Prize: $1060. Gift card subject to applicable terms and conditions, including dormancy fees, and may not be used for the purchase of alcohol or tobacco. All expenses not specified herein, including but not limited to meals and gratuities are solely the responsibility of the winner. Finalists and travel companions must possess valid travel documents (i.e., valid photo ID) in order to travel. While at the Grand Prize event the (5) finalists will have the chance to win the Grand Prize consisting of one (1) Ryland Home valued up to $150,000.00, as set forth herein. Grand Prize Home will be awarded in a Ryland Homes community, in a location of Sponsor's selection, in the Austin area, Houston area or San Antonio area. No other locations are available. Winner must acknowledge that there may be some variances in home size, lot size and/or other features based on market differences. Winner must accept the house "as is" at completion with no option for choice of color, design, options or fixtures and appliances. Winner will be solely responsible for all costs and expenses associated with the winner's acceptance and ownership of the house including upkeep, maintenance, landscape costs, insurance, property and real estate taxes (present and future) and all other necessary and incidental fees as of the date that title and deed are transferred to winner. Deed will not be available to winner and house will not be available for occupancy until the required affidavit and release documents and any other required documents as determined by Sponsor have been executed by the Grand Prize Winner. Sponsors shall not be responsible for any delay in construction. Approximate Retail Value of Grand Prize is $150,000.00. Grand Prize House will be selected by Sponsor and any additional options desired by the winner will solely be the responsibility of the winner. The house displayed and/or pictured in promotional materials may not be the house awarded. Grand Prize winner may elect to receive a cash prize value in the amount of $75,000 in lieu of the Grand Prize House. Fifty (50) First Prizes will be awarded, consisting two (2) 1-day tickets to SeaWorld San Antonio. Estimated retail value of First Prize is $80.00. Sponsors assume no liability or responsibility in connection with the safety or performance of any prize awarded hereunder nor in connection with any warranty or representation therewith. 3. DRAWING: Finalist/First Prize Drawing: Prizewinners will be selected in a random drawing from among all eligible entries received. Drawing will be held on or about June 7, 2004 in Melville, NY, and will be conducted by Don Jagoda Associates, Inc, an independent judging organization. All decisions of the judges shall be final. Odds of winning depend upon the number of eligible entries received. GRAND PRIZE GIVEAWAY: ALL FINALIST WINNERS MUST BE PRESENT OUTSIDE THE MAIN GATES AT SEAWORLD SAN ANTONIO AT APPROXIMATELY 10 A.M. ON SATURDAY, JUNE 26, 2004 TO BE ELIGIBLE TO PARTICIPATE FOR A CHANCE TO WIN THE GRAND PRIZE HOUSE. If, for any reason, any of the Finalists is not in attendance and are therefore ineligible to participate in the Grand Prize Event, the Grand Prize Event will proceed with the remaining Finalists who are in attendance. Prior to the Grand Prize event start time, the five (5) Finalists will be randomly assigned a key, by an independent judging agency, to attempt to open a replica Front door of a House. The five (5) Finalists will have the opportunity to try to open the Front door. The key holder with the key that opens the Door will be declared the winner. If, due to a production or other error, more than one distributed key opens the Door, the Grand Prize House will be awarded in a random drawing from among all Finalists in possession of a working key for that Grand Prize House. In the event that the Grand Prize key is not among those selected by the eligible Finalists, the independent judging agency will conduct a random drawing among all Finalists present at the Grand Prize Giveaway. Odds of a Finalist winner receiving the key that opens the Front Door are 1 in 5. 4. ELIGIBILITY: Sweepstakes open to legal residents of Texas, age 21 or older only. Employees of H-E-B Grocery Co. L.P. ("H-E-B"), Ryland Homes, SeaWorld, Inc., PepsiCo, Inc., The Pepsi Bottling Group, Pepsi-Cola Company, its bottlers, affiliates, distributors, suppliers and advertising, promotional or judging agencies and immediate family members of such employees are not eligible to win. No substitution of prizes is offered, no transfer of the prize to a third party is permitted, and noncash prizes may not be redeemed for cash value except as described within these rules. Limit one prize per family, address and/or household. Void wherever prohibited or restricted by law. All federal, state and local taxes based upon the retail value of the prizes as set forth in these rules are the sole responsibility of the prize recipient. If applicable, winner may receive an IRS form 1099 for the retail value of the prize. No groups, clubs or organizations may reproduce or distribute any portion of these rules to their members. All entrants, as a condition of entry, agree to be bound by these rules and the decisions of the judges. 5. WINNER NOTIFICATION/RELEASES: All Finalists and First Prize Winners will be notified by phone or mail. Finalists and First Prize Winners may be required to sign and return an affidavit of eligibility and liability/publicity release within seven (7) days of notification before prize (including participation in the Finalist Drawing) will be awarded. In the event the affidavit and release is not returned within seven (7) days, prize may be forfeited and an alternate winner may be selected. Prize may also be forfeited if the notification is mailed to the address listed on entry form and returned as undeliverable mail without a forwarding address. Grand Prize Winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release and any other document required in connection with transfer of the Grand Prize before the Prize will be awarded. All winners, by acceptance of a prize, agree to release H-E-B, Ryland Homes, SeaWorld, Inc., PepsiCo, Inc., The Pepsi Bottling Group, and Pepsi-Cola Company, its bottlers, affiliates, suppliers, distributors and advertising, promotional or judging agencies from any and all liability for injuries or damages sustained in connection with the receipt, ownership or use of the prize or while preparing for, participating in, and/or traveling to any prize-related activity. Winner acknowledges that the aforementioned have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to quality, merchantability, condition or fitness, except for any express manufacturer's warranty as may be included in the purchase agreement. All travel and transportation costs associated with taking possession of any prize will be the sole responsibility of the winner. Except where prohibited or otherwise restricted by law, winners must consent to the use of their names, voices, pictures or other likenesses for promotional purposes as determined by the contest promoters. 6.
